New York Mayor Zohran Mamdani said his city doesn’t have the ability to arrest Israeli Prime Minister Benjamin Netanyahu.


In a video posted to Instagram — with a caption that read: “Benjamin Netanyahu is a war criminal” — Mamdani said it’s clear the Israeli prime minister belongs before a court of law. Yet in that video, he also conceded that the city can’t be the one to detain him.


“My administration has reviewed every avenue available under applicable law to determine whether New York City could execute the International Criminal Court’s arrest warrant if Benjamin Netanyahu came here,” Mamdani said.


“It is clear that we do not have the independent legal authority to enforce this warrant,” he said, adding that the US federal government should do so instead.


President Donald Trump made it clear earlier this week that wouldn’t happen.


“Benjamin Netanyahu will not be arrested, in any way, shape, or form, while in the United States of America,” Trump wrote in a post on social media on Monday.


Heads of state traditionally enjoy diplomatic immunity while in the US on official business. What’s more, the US routinely allows government leaders and officials even from countries it considers openly hostile to come to New York as part of its duties as a host location for the UN General Assembly.


The ICC issued an arrest warrant for Netanyahu in November 2024, accusing the leader of war crimes and crimes against humanity. Yet the US is not a party to the ICC and isn’t legally bound to enforce its warrants.


The Trump administration has also been openly hostile to the court as a whole, targeting it with sanctions and faulting the body for what Trump said at the time were “illegitimate and baseless actions targeting America and our close ally Israel.”


Israel has rejected accusations it has committed genocide against Palestinians, saying that its war in Gaza was a legitimate defense of its people and a justified response to the Oct. 7, 2023 attack by Hamas, when militants stormed into Israel, killing around 1,200 people and taking roughly 250 hostage. Hamas is considered a terrorist group by the US and European Union.


Israeli military operations have, in turn, leveled much of Gaza and left more than 73,000 people dead, according to the territory’s Hamas-run health ministry.
